Dazmode.com Purchase Agreement

 

By accepting delivery of any product purchased from Dazmode.com ("Dazmode"), you ("Customer") agree to be bound by the terms and conditions listed below. You and Dazmode agree that the following terms and conditions are the exclusive terms governing the sales transaction between Customer and Dazmode. Any attempt to alter, supplement, modify or amend these terms and conditions by the Customer will be considered a material alteration of this agreement and, therefore, are null and void. In addition, these terms and conditions are subject to change by Dazmode at any time, without prior written notice. Therefore, please check these terms and conditions carefully each time you place an order with or accept delivery of any goods from Dazmode.

 

 

Orders  

An order is not binding upon Dazmode until it is accepted; Dazmode must receive payment before it will accept an order. Payment for product(s) ordered is due prior to shipment.

 

Payment Methods

 EMT (Web Banking Interac E-mail Money transfer);

 Credit cards (Visa, Mastercard, Amex);

 PayPal;

 Dazmode Gift Certificate;

 All payments will be made in Canadian Dollars.

Shipping Methods

• All orders require 1-2 business days of processing time prior to shipping;

• Standard shipping method is by Canada Post (Expedited Parcel);

 

Cross-Ship

Dazmode.com does not cross-ship.

 

Promo Codes

Dazmode.com may sometimes issue an alphanumeric code that can be used for promotions on our web site. These promotional codes may be found in online advertisements, sent via email to our Newsletter. Some of the specials offered by entering a Promo Code during checkout include free shipping, volume discounts or free gifts. Promo Codes are not redeemable for cash and you must spend more than the discount price in order for a promotion to be applied. For example, if a Promo Code offered $5.00 off your next purchase, you would need to spend more than $5.00 to redeem your discount.


Reward Points

Dazmode.com offers customer loyalty Reward Points program.


Points are awarded at the pre-defined rate for each dollar spent. Points will be calculated by reference to the net (purchase price less discounts) pre-tax total.


Points stay "Pending" for 10 days, after grace period they are transferred to "Earned" and available for redemption. In case of a product returns Reward Points will be deducted automatically from the Customer's balance. Points expire after 360 days.
 

"Earned" points may be redeemed at pre-defined rate of "100 points = $1" at order checkout. Points can only be redeemed if the required minimum point redemption level of 250 points is acquired prior to the redemption transaction.


Dazmode will not be liable or responsible in any manner for any tax consequences which may flow from any participation in the Reward Points Program by Customer.


Points have no cash value and are not exchangeable for cash. Points cannot be assigned, exchanged, purchased or given by gift.  Points cannot be sold, traded, bartered, rented or otherwise disposed of.


Dazmode may restrict, suspend or otherwise alter any aspect of Reward Points Program, without notice. Upon suspension or termination of the Rewards Points Program for any reason whatsoever, Dazmode will have no liability therefore to any Customer and is automatically released from all claims by Customer in respect of such suspension, termination, forfeiture of Reward Points, redemption of Points or otherwise in respect of such suspension or termination.

 

Sales Tax

All items sold to Canadian customers are subject to Canadian Goods and Services Tax ("GST") at 5%. In addition, the following Provincial Sales Tax ("PST") or Harmonized Sales Tax ("HST") might apply, depending on the item and the destination of the shipment:

Product Testing

Dazmode ships new items in the condition they were received from the original manufacturer or distributor and does not conduct product testing before shipping any merchandise.

Used items are fully tested by Dazmode.com.

 

Refund Policy/Returns

· UNUSED, ORIGINAL SEAL PACKAGED merchandise unless otherwise indicated may be returned within 30 days from the original invoice date for a refund. A return authorization number is required for all returns.

· USED AND/OR OPEN BOX WATER COOLING EQUIPMENT is not returnable and not refundable;

· Custom cut tubing (hose) is not returnable or refundable;

· Cooling Liquids are not returnable or refundable;

· Any refunds excludes original shipping;

· Customer pays for return freight.

 

Physical Damage Policy

Physical or chemical damage to any product purchased at Dazmode.com will effectively void the manufacturer's warranty coverage. Dazmode.com will return any physically or chemically damaged product back to the customer at the customer's expense.

 

Restocking Fee

A 10% restocking fee will be applied to all returns for refund. No refunds after 30 days.

 

Technical Support

Dazmode.com does not offer any sort of formal technical assistance. Any advice on compatibility of items, product recommendations or technical support is provided on “Best Effort” basis. All information is offered for information purposes only and does not carry any liability whatsoever.

 

Processing Time

You can expect your order to be processed within approximately 24-48 hours, provided the items are in stock and there are no problems with payment verification. Dazmode.com does not guarantee same day-shipping. Orders are not processed on weekends and holidays. International product delivery could be delayed due to Customs.

 

Pre-orders and custom orders

Dazmode.com offers custom product orders for rare items or out of stock items. Please, contact customer service: (416)840-2800.

 

Back-orders

Back orders are permitted only for Aastra IP Telephony products.


Dazmode.com does not sell back-ordered water cooling merchandise. We will never purposely charge a customer for an item that we do not physically have in stock at the time of purchase. Occasional inventory discrepancies may occur due to inaccurate inventory counts or possibly because the last few items on our shelves are damaged and/or not in a condition that we can in good faith sell to a customer. If you are erroneously charged for an out-of-stock item, we will refund your credit/debit card for the item, along with any applicable tax fees and shipping charges.


Order status

Dazmode will keep you informed of your order status via e-mail. All tracking information will be emailed to you by Canada Post's  shipping system once your order has shipped.

 

Security

Security is our number one priority. All on-line transactions are processed through secure payment gateway and encrypted. Dazmode.com does not store or process your credit card information locally.

Due to human error and other factors we cannot guarantee that all item descriptions, photographs, compatibility references, detailed specifications, pricing, links or any other product-related information listed is entirely accurate, complete or current, nor can we assume responsibility for these errors. In the event a product listed on our website is labelled with an incorrect price due to some typographical, informational, technical or other error, Dazmode.com shall at its sole discretion have the right to refuse and/or cancel any order for said product and immediately amend, correct and/or remove the inaccurate information. Additionally, all hyperlinks to other websites from Dazmode.com are provided as resources to customers looking for additional information and/or professional opinion. Dazmode.com does not assume responsibility for the claims and/or representations made on these or any other websites.

 

Product Revisions

Dazmode is not responsible for changes or variations in product specifications and/or physical appearance. In the interest of our customers, Dazmode.com puts forth its best efforts to ensure that all product information is up-to-date and factual. Unfortunately there are various factors which, although infrequent, could cause the information on our website to become outdated without our immediate knowledge. These include but are not limited to new versions or revisions, color deviations, retail package alterations and other variations that may be considered inconsequential by the manufacturer. Dazmode.com relies on the manufacturer to communicate these differences. Presently we have no way of alerting customers prior to purchase in the event the manufacturer fails to notify us. Consequently, Dazmode.com will not be held responsible for product revision changes.

All review submissions are subject to moderation by Dazmode.com . Please follow our submission guidelines.

What to include in your submission:

· Experiences with a fully-functional product leading to perceived pros and cons;

· Thoughts about the product's feature-set as you've experienced it.

What NOT to include in your submission:

· Profanity, obscenity and other offensive language;

· Single-word reviews;

· Any mention of Dazmode's competitors by name;

· URLs, specific pricing, and specific availability (or other time-sensitive information);

· Experiences with a DOA, defective, damaged or otherwise semi-functional product;

· Reviews that criticize the brand without a majority of the review offering product-specific insight;

· Dazmode.com reserves the right to accept or reject any review in its sole and absolute discretion.

ALL ITEMS SOLD THROUGH DAZMODE ARE SOLD "AS-IS" OR "WITH ALL FAULTS." THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THESE ITEMS IS WITH THE BUYER. SHOULD ANY OF THESE ITEMS PROVE DEFECTIVE, NOT FUNCTION, OR FUNCTION IMPROPERLY IN ANY WAY FOLLOWING THEIR PURCHASE, THE BUYER, AND NOT THE MANUFACTURER, DISTRIBUTOR, OR DAZMODE , ASSUMES THE ENTIRE COST OF ALL NECESSARY SERVICING OR REPAIR.

 

LIMITATION OF LIABILITY

IN ALL CIRCUMSTANCES DAZMODE 'S MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. DAZMODE SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. DAZMODE SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, SPECIAL DAMAGES OR EXEMPLARY DAMAGES, WHETHER OR NOT DAZMODE HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.

 

GENERAL TERMS AND CONDITIONS

Governing Law and Jurisdiction: Any dispute arising out of or related to these Terms and Conditions or the sales transaction between Dazmode and Customer shall be governed by the laws of the Ontario, Canada without regard to its conflicts of law rules. Finally, the Customer also agrees not to bring any legal action, based upon any legal theory including contract, tort, equity or otherwise, against Dazmode more than one year after the date of the applicable invoice.

Severability: If any provision contained in these Terms and Conditions is or becomes invalid, illegal, or unenforceable in whole or in part, such invalidity, illegality, or unenforceability shall not affect the remaining provisions and portions hereof , and the invalid, illegal, or unenforceable provision shall be deemed modified so as to have the most similar result that is valid and enforceable under applicable Ontario law.

Waiver: The failure of either party to require performance by the other party of any provision of these Terms and Conditions shall not affect in any way the first party's right to require such performance at any time thereafter. Any waiver by either party of a breach of any provision in these Terms and Conditions shall not be taken or held by the other party to be a continuing waiver of that provision unless such waiver is made in writing.

Entire Agreement: These Terms and Conditions, together with Dazmode 's invoice regarding the products ordered by Customer, are the complete and exclusive agreement between Dazmode and Customer, and they supersede all prior or contemporaneous proposals, understandings, representations, conditions, warranties, and all other communications between Dazmode and Customer relating to the subject products , whether oral or written . This agreement may not be explained or supplemented by any prior course of dealings or trade by custom or usage.

Customer and Dazmode agree that these terms and conditions shall be entered into in the English language and interpreted in English. Le client et Dazmode acceptent que ces termes et conditions sont lus en langue Anglaise et interprété en Anglais.
